Texas Attorney General Ken Paxton is suing five cities — Austin, San Marcos, Killeen, Elgin and Denton — to block their ordinances decriminalizing low-level marijuana possession.
In 2022, voters in the five cities approved policies that would end arrests and citations for possession of less than four ounces of marijuana. An initiative spearheaded by Ground Game Texas — the progressive group that first launched the proposition in Austin — worked with local organizations in the other four cities and succeeded in pushing for similar policies to appear on the ballots.
Paxton said in a Wednesday press release that the cities violated state laws and the Texas constitution concerning marijuana possession and distribution, claiming it to be unlawful for municipalities to adopt ordinances inconsistent with laws enacted by the Texas Legislature.
The ordinances had high levels of support. Austin received an overwhelming 85% of votes in support. In San Marcos, about 82% of votes were in favor. Elgin followed with almost 75% of votes in support. Denton, home to two universities, had about 71% votes in favor. Killeen had close to 70% in support.
The five cities are home-rule cities — jurisdictions that under the Texas constitution are allowed to establish any law or ordinance unless it’s expressly forbidden by state or federal law. However, Paxton argues the Texas Local Government Code forbids them from adopting policies that would result in not fully enforcing drug-related laws. Paxton is seeking to repeal the city's ordinances and make them enforce state law.
“I will not stand idly by as cities run by pro-crime extremists deliberately violate Texas law and promote the use of illicit drugs that harm our communities,” Paxton said.
A spokesperson for the city of Austin said it will issue a comment Thursday. Officials for the other four cities couldn’t be reached for comment Wednesday evening.

ELGIN, Texas (KXAN) — A fire that displaced a family of five in Elgin highlights some staffing and procedural concerns regarding fire operations in the city.
The fire happened at the Cooper family’s home early in the morning on July 4. Chief Chris Botello, who was in command on scene, said the firefighters did everything they could, but he “wishes [they] could have done more.”
“We’re not walking away with anything besides our lives,” Deja Cooper said, adding that one firefighter ran into the house to save the family’s puppy when the fire was still raging.
She said her husband woke her up in the middle of the night telling her the house was on fire and that they and their three children needed to get out quickly.
“Looking up at him, and I just see this cloud of smoke,” she said. “Entire back of the house was in flames, and there was so much smoke that it was hurting our eyes.”
The house is gutted. The roof is gone. When you look closely, you can see signs of what it used to look like. A shiny purple bike contrasted against a black, charred porch. Books still tucked away on the shelf, hiding behind burned wooden panels.
“A total loss like this is more common in rural areas where they’re fully dependent on volunteers with an extended response time,” Nicholas Teague, the fire chief and EMS program director for the Texas Public Safety Training Academy in Bastrop, said. He added the emergency services district where the Coopers live — Bastrop-Travis ESD 1 — should have more money allocated towards fire staff.
Chief Botello agreed staffing needs to become more of a priority.
“It’s a catalyst to us moving forward a lot faster with our hiring process,” he said.
Botello also said he’s looking into the dispatch details of the call because he said there have been communication snags recently when people call 911 with Elgin being on the border of Bastrop and Travis Counties.
“These guys that came to our house last night, we know them personally. We see them every day,” Cooper said. “We know they did everything they could when they were here.”
KXAN reached out to Bastrop-Travis ESD board members about the staffing concerns. One deferred us to the chief’s comments, and others have not responded yet. This story will be updated once any other responses are shared.

A popular Austin brewing company shuttered its original location earlier this year after more than a decade, leaving only its newer Elgin operation open. For fans of the brand's Blur hefeweizen, there's some more bad news out there this week.
On Monday, September 18, Circle Brewing announced that it is completely shutting down after almost 15 years in business.
"It is with a heavy heart and the utmost sadness that we must announce the closing of Circle Brewing Company," the owners Ben Sabel and Judson Mulherin wrote on Facebook, acknowledging that the COVID-19 pandemic played a major factor in the demise of the business.
Started in 2008, the original Braker Lane location opened its doors in 2010, first as a distribution-only brewery and eventually as a taproom. That era saw an enormous upswing in breweries opening all over Central Texas, like Austin Beerworks, Jester King, and 512 Brewing, among dozens of others.

In 2019, the company purchased 23 acres in Elgin, just east of Austin. The idea was to create a brewery that was fully farm-to-glass: grown, brewed, and poured onsite.
"Then Covid came along to ensure the buildout took forever and cost twice as much," the owners wrote.
Sabel and Mulherin write that their biggest regret is not seeing the Elgin vision through.
"It was a one-of-a-kind concept, a beautifully constructed facility, and located on a plot of land with limitless potential and a wonderfully supportive community," they wrote." It was so close to becoming reality. We're sorry we didn't have the time to see it to the end."
The brewery is holding a final sale at its Elgin facility, selling off remaining stock, which includes draft beers, six packs, and merch, from 11 a.m. to 10 p.m. beginning on Tuesday, September 19, and ending on Sunday, September 24.
"Our beers were always our pride and joy and our sole guiding principle was to always make sure that the beer came first," they wrote. "Thank you all for enjoying our dream, one pint at a time."

AUSTIN, Texas — A North Austin brewery is closing both of its locations after 15 years.
Circle Brewing Company announced the permanent closure Monday night on Facebook of its brewery located on West Braker Lane and its new Elgin location next week.
"It is with a heavy heart and the utmost sadness that we must announce the closing of Circle Brewing Company. It is hard for us to believe that we have been at this for almost 15 years, although some of those years certainly went by faster than others," the owners said in the lengthy statement.
Circle Brewing Company said it opened its doors in 2008 with only two draft beers: Blur Texas Hefe and Envy Amber and barely a dozen draft accounts. Ben and Jud, co-owners of the brewery, add it was a different time to run and operate a brewery because of the "real spirit of camaraderie."
"In our first two years of operation, we were so broke that we couldn't even afford to buy yeast. But the Austin brewing community and the real spirit of camaraderie was such that we just had to drive out to Blanco and fill up a few corny kegs from our friends at Real Ale.
After the brewery shifted its model from 100% distribution to a taproom focus, Ben and Jud saw the chance to open a second location in Elgin.

In 2019, they bought 23 acres in the downtown area, but then the COVID-19 pandemic hit, which caused the project to cost twice as much to complete and extended the opening date to May of 2023.
"Our grand vision was to grow the ingredients to use in the brewing process," Ben and Jud explain. "Be the first brewery to be able to grow everything that goes into our beer right there, on site. A fully sustainable beer grown on our farm, 100% Texan, from seed to glass. And we were on our way to starting to grow test plots of row crops this fall."
"We're sorry we didn't have the time to see it to the end," they add.
Circle Brewing Company will keep its Elgin facility open for another week and host a firesale on all remaining drafts (14 in total), six packs, and merchandise from 11 a.m. to 10 p.m. from Tuesday, Sept. 19 through Sunday, Sept. 24.

ELGIN, Texas—Designer Pfluger Architects and general contractor Satterfield & Pontikes Construction joined officials from the Elgin Independent School District recently as they collectively toasted the groundbreaking of the new Harvest Ridge Elementary, the fourth elementary school for the Elgin ISD. Harvest Ridge Elementary will serve students from pre-K through 5th grade. Funding for the project comes from the district’s $183 million bond program, passed by voters in November 2021.
“This is such an exciting moment for the Elgin community,” Elgin ISD Superintendent of Schools Dr. Jana Rueter said at the groundbreaking. “Harvest Ridge Elementary will provide a safe and nurturing environment for students to learn and grow, fostering a sense of community and collaboration. Future staff and students will benefit from the school’s overall design, which reflects Elgin ISD’s commitment to providing high-quality education for its students.”
Harvest Ridge, which will be home to 800 students, will be sited on a 13-acre plot of land the district owns in the immediate vicinity of Elgin High School. The design for the school incorporates innovative designs meant to increase learning capabilities at Harvest Ridge, and inside the classrooms will boast up-to-the-minute technology. Additionally, the elementary school will offer a music room, gym, art room, library, cafeteria and outdoor learning spaces.
Pfluger and Satterfield & Pontikes are working in conjunction with Lockwood, Andrews and Newnam, Inc. (LAN), which is acting as program manager for the district’s bond program and thus will oversee budgeting and execution of the construction and renovation work throughout the district. In addition to Harvest Ridge, LAN will be shepherding to completion an additional elementary school, upgrading Elgin High School, and making various other improvements throughout the Elgin ISD.
One of the challenges of this particular project, according to Tim Strucely, LAN Associate and Program Manager for Elgin ISD’s bond program, is that the district will be constructing the school as part of a new subdivision.
“The developer is extending the main boulevard out to and beyond the school construction site, as well as constructing all of the utility infrastructure,” Strucely said in a statement emailed to School Construction News, offering that the project “is happening in parallel with the construction of the school site. The developer built a temporary construction road to allow us to physically access the school site.”
Strucely added that he and his firm are dedicated to providing a first-class school for the Elgin ISD that will meet the community’s needs.
As currently projected, the new elementary school will open for students in the fall of 2024 for the Elgin ISD, which educates over 5,000 students in grades K through 12.
“We are excited to celebrate this investment in our community, and our children, and to see this new facility come to life,” enthused Rueter, the superintendent.
LAN, which employs nearly 400 professionals around the country, falls under the umbrella of the LEO A DALY companies, an internationally recognized engineering and architecture firm.
